These Terms and Conditions govern your access to and use of The Hive website, platform, and services, and every purchase of solar products and accessories from us. By using our Platform or placing an order, you agree to be bound by these Terms.

1. Definitions

  • "The Hive," "we," "us," or "our" means The Hive, an online retailer of solar products and accessories in Zimbabwe.
  • "Platform" means our website and any associated ordering, payment, or communication channels.
  • "Customer," "you," or "your" means any person who accesses our Platform or places an order.
  • "Products" means solar panels, batteries, inverters, solar kits, flood lights, street lights, accessories, and any other goods listed on our Platform.
  • "Order" means a request by you to purchase Products from us.

2. Use of the Platform

You must be at least 18 years old, or acting with the consent of a parent or legal guardian, to make a purchase. You agree to provide accurate, current, and complete information when registering or placing an Order.

We reserve the right to refuse service, terminate accounts, or cancel Orders where false or misleading information is provided, or where we reasonably suspect fraudulent activity.

3. Product Information & Pricing

We make every effort to display accurate descriptions, specifications, images, and prices. However, product specifications may change without notice due to manufacturer updates. Images are for illustrative purposes and may not always reflect the exact physical appearance of the product received.

All prices are listed in United States Dollars (USD) unless otherwise stated and include applicable local taxes where required. Prices may change at any time without prior notice, but changes will not affect Orders already accepted by us.

Product availability is subject to stock on hand and supplier inventory. We reserve the right to limit quantities, discontinue products, or cancel an Order if an item becomes unavailable.

4. Orders & Acceptance

Placing an Order through our Platform constitutes an offer to purchase. An Order is only accepted once we confirm it by email, WhatsApp, SMS, or by delivering the Products to you.

We may decline or cancel an Order for reasons including, but not limited to:

  • product unavailability;
  • errors in pricing or product information;
  • suspected fraud or abuse;
  • inability to verify payment or delivery details.

5. Payment

Payment must be received in full before an Order is dispatched, unless we have agreed to cash on delivery or another approved arrangement in writing.

Accepted payment methods may include EcoCash, ZIPIT, bank transfer, Visa, Mastercard, and cash on delivery where available. You are responsible for any bank or transaction charges associated with your chosen payment method.

All payments are processed securely. We do not store full card or mobile money PIN details on our Platform.

6. Delivery & Risk

We deliver to addresses within Zimbabwe. Delivery timeframes are estimates only and depend on stock availability, destination, courier schedules, and factors outside our control.

Risk in the Products passes to you upon delivery. You must inspect goods at the time of delivery and note any visible damage or missing items on the delivery documentation. Failure to do so may affect your ability to claim for damaged or missing goods.

If you fail or refuse to accept delivery, or provide incorrect delivery information, we may charge additional delivery fees or cancel the Order, and any refund will be subject to our Returns & Warranty Policy.

7. Ownership

Ownership of the Products remains with The Hive until full payment has been received and cleared. Until such time, you agree not to sell, dispose of, or encumber the Products.

8. Returns, Warranty & Repairs

Our Returns & Warranty Policy sets out when and how Products may be returned, repaired, replaced, or refunded. That policy forms part of these Terms and is available at /returns.

In summary, returns are handled in accordance with the Consumer Protection Act [Chapter 14:44] of Zimbabwe. Non-returnable items include custom-configured kits, delivery/installation costs, damaged or abused items, and products that have been installed or altered. A handling fee of up to 20% may apply where goods are not returned in original condition.

9. Intended Use & Installation

Our Products are sold for standard domestic, business, or off-grid solar use, for the purpose for which they were manufactured. You are responsible for ensuring that any installation, wiring, or configuration is carried out by a competent, licensed, or qualified person where required.

The Hive is not liable for damage, injury, or loss caused by incorrect installation, misuse, overloading, incompatible components, or failure to follow manufacturer instructions.

10. Limitation of Liability

To the fullest extent permitted by Zimbabwean law, The Hive will not be liable for any indirect, consequential, special, or punitive loss or damage arising from the use of our Platform or Products, including loss of profits, revenue, data, or business opportunity.

Our total liability to you for any claim arising out of or in connection with an Order will not exceed the amount paid by you for the relevant Products.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable consumer protection or other laws.

11. Intellectual Property

All content on our Platform, including text, images, logos, designs, and software, is the property of The Hive or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or exploit any content without our prior written consent.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your Personal Information. The Privacy Policy is available at /privacy.

13. Governing Law & Disputes

These Terms are governed by the laws of Zimbabwe. Any dispute arising from these Terms or your use of the Platform will first be attempted to be resolved through good-faith negotiation. If unresolved, either party may pursue remedies available under Zimbabwean law.

14. Changes to These Terms

We may update these Terms from time to time. The version published on our Platform at the time of your Order applies to that Order. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
